General

By registering and/or placing an order you agree you have read and accepted the Terms and Conditions of POWERFUL SIGNATURE  ('The Seller' or 'The Business') below. You can make copy of the dated Terms and Conditions.

Customer and product registration

You agree that you are aware that purchasing as a registered customer, your account name, your name, shipping/billing address and email address, are stored for the purpose of processing the order and the final payment. To be able to process your order, cookies are used for the functioning of The Business web site. Purchases made as guest or registered customer are automatically registered for the Makers Guarantee. The personal details are kept for purchase registration. You agree never to share your login or registration details with anyone else.

Customer buying goods on Shows

Purchases made using Cash or Card in person are registred on The Business website for legal and tax reasons and to record the Makers Guarantee. Customers not providing an email have no option to access an online account but the Makers Guarantee remains registered based on an invoice number and date. Customers providing only a name or phone number must pay via a Card. Customer providing an email will receive a receipt via email and are then given the option to register for an online account on The Business website. If no email has been received within 7 days from the date of purchase, then the customer has the responsiblity to contact The Seller no later than 7 days from the date of purchase. Promotion Vouchers

Vouchers given to existing customers after a purchase can used for a new purchase or be given to someone else as a gift. Voucher related to a promotion are subject to promotional conditions.

Tax general

The buyer agrees to pay all required Custom and Excise duties when buying goods from The Seller from overseas territories. The buyer agrees to be aware that this will not be refunded by The Seller. The goods will be properly declared by The Seller as required by Custom and Excise Regulations.

Shipping

Parcels will be send to the customer using tracked, signed and insured postage. The postal transfer times varies by national region and state, orders to Canada can take 6 weeks to pass Custom and Excise, The Seller is not responsible for such delays. Items over £75 are covered with an insurance. Items lower than £75 can be insured on request.

Postal Areas

The areas and postal charges are given on the page Order & Delivery. Deliveries may be delayed due border control regulations such as, but not limited to, COVID. It is the buyers repsonsibilty to consult their local Government.

EU

The Seller does no longer sell to customers in the European Union since 1 May 2022 due to overcomplexity of the EU regulations. Existing customers who bought a product will still be serviced.

Order / Buying & Cancelling

- If a query is made to a customer related to an order, an no response follows within 7 days, then The Seller reserves the right to cancel the order.
- If an invoice has been send out and no payment follows within 7 days, then The Seller reserves the right to cancel the order  and invoice.
- Your statuary rights and duties regarding buying, cooling off and returns are governed by United Kingdom Law and Trading Standards. You agree that any dispute will be governed by UK law only.

Returns

In case you wish to return the goods, you must place the return request within 14 days of the purchase date. You agree you will send the parcel signed back to the Seller within 14 days from the notice to return. It is your responsibility to insure the parcel incase the parcel has been lost or damaged in transit.
The UK Refund will only be given when the goods have been received by The Seller within the 30 days from the date of purchase and must be received back without damage.
The International Refund will only be given when the goods have been received by The Seller within the 45 days from the date of purchase and must be received back without damage.

Documents for Refunds

To be eligible for a refund, you must send to The Seller via email the copy of the invoice and the delivery showing the delivery date within the time specified above. When sending the parcel back to The Seller, you must add a clear and complete copy of the delivery note together with the original certificate. Incomplete returned parcels will not be refunded. Make sure you keep a copy of the certificate incase you need this for reference.

Refund Payments

The Seller will only send refunds to the account you have used for the purchase. You agree it is your responsibility to check that a refund is possible before paying to The Seller.

Certificates - keep you documents

Each product over £140 comes with a certificate of provenance and authenticity associated to the buyers name, unless otherwise statet. I you ever decide to sell the product to someone else then the provenance is important and to assure that the new buyer can contact The Seller should there be a need for support or any questions. If you have an paper certificate without an NFC tag, then contact via the contact page if you want to check the provenance.

Border exchanges

It is not possible to cancel the order after sending the purchase. Should we discover before sending the parcel that there is a mayor obstacle(s) to send this, then we will inform you about this. You can then decide to go ahead or to cancel the order. Should we discover after sending the parcel that there is a mayor obstacle(s) to send this, then we will inform you about this. The Seller is unable to cancel shipment in transit. Should the parcel be returned to The Seller as not deliverable, then we will contact you. You then can decide to cancel the order for a refund or restart the delivery. The Seller will only make 2 attempts to deliver, should the parcel return after a second attempt then the purchase amount will be reimbursed minus the postal charges.

Makers Guarantee

The fountain pen and Calligraphy pen has a Makers Guarantee of 2 years to cover any manufacturing defects. Damages due to falling and breaking or damages caused by force, over turningdamaging the threading, the use of agressive cleaning, damage due to leaving the pen in the sun or a hot surface, are not covered.

Disclaimers

Desk pens are show piece to be kept on a desk, they have deliberately no clip. Always be gentle with the pen. The workmanship is guaranteed for 2 years. A standard Jowo nib and converter is included in the purchase, high-end Nibs are chargeable. Information can be found on the Nib info page.

Close the pen when not using to avoid drying out. Clean the pen nib and tank with water when you plan not to use the pen for long periods. Damages due to heat, falling, scratching, breaking or using too much force closing or writing with to much pressure is not covered. Keep the pen out of direct sunlight and never put a pen on hot surfaces.

Empty the ink tank before flying in an airplane to avoid leakage due to air pressure changes. Repairs are possible but only as long stock exits, this may be at a charge. The pen works with common ink brands but use only calligraphy ink when the nib specifically made for his ink.

Though the pen can accept cartridges it is advised to avoid ink them as some cheaply made version can cause damage when using to much pressure adding them. Damages due to using cartridges are not covered.

Keep out of reach of children, fountain pens are not suitable for children, they contain sharp points and some parts can be taken off and swallowed. You agree to use pens only as intended.

Learning models (made in 2017) sold on fairs at a discount are not as perfect as the level I want everything to be and was able to acquired in 2018. However they are still proper well made pens. The cover for these was up to 6 months from the date of purchase.

Legals

The Business is owned by Rob van Nigtevecht, a sole trader registered in the UK, trading online and on fairs. The Business has no shop premises to visit. The Seller cannot be held responsible for delivery problems caused by Force Majeure. The Seller cannot be held responsible for any delays, damages or lost items in transit. The Seller cannot be held responsible for any loss of data or late responses from The Seller to the Customer caused by email and internet service providers beyond the control of The Seller. The Seller is a sole trader in the UK and all legal disputes are governed by UK law only. The Seller reserves the right to change the Terms & Conditions, without any notice. The Seller reserve the right to update or revise these Terms of Use at any time without notice. Please check the Terms of Use periodically for changes. The revised terms will be effective immediately as soon as they are posted on the WebSite and by continuing to use the Site you agree to be bound by the revised terms.

Crawling the Services is allowed if done in accordance with the provisions of our robots.txt file, but scraping the Services is prohibited. Violating this may lead to legal action and abusive crawling details are logged.
